Buying property in Gazipaşa is safe if you check four things before paying a deposit: the title deed record (owner, mortgages, attachments), the building's status (construction servitude or condominium title, and whether it has an occupancy permit), the developer contract and — for land — the zoning of the plot. Below is the checking order we use with clients in Gazipaşa.
Why extra care is needed in Gazipaşa
Gazipaşa lies about 40 km east of Alanya, next to Gazipaşa–Alanya Airport. Many new residential projects have been built in recent years, and part of the market is off-plan units and land plots. Prices are lower than in Alanya, but legal surprises are more common: the building may lack an occupancy permit, the plot may not allow construction, or the seller may not be the sole owner.
Step 1: Check the title deed
- Owner — is it the seller, and are there other co-owners (hisseli tapu)?
- Encumbrances — mortgage (ipotek), attachment (haciz), sale bans and other annotations.
- Type and area — apartment, building plot or agricultural land.
- Authority — the scope of the power of attorney if the seller acts through an agent.

Step 2: Kat irtifakı, kat mülkiyeti and iskan
In new projects, apartments are often sold with kat irtifakı — a right to a future unit in a building not yet approved for occupancy. Full ownership (kat mülkiyeti) is established after the occupancy permit (iskan). Without iskan you may face problems with permanent utility connections, resale and residence-permit or citizenship applications.
Step 3: The developer contract
- exact description of the unit, block, floor and area;
- delivery date and delay penalty;
- payment schedule and refunds if the project stops;
- who pays taxes and fees at title transfer;
- contract language and a certified translation.
Step 4: If you are buying land
Obtain the zoning status (imar durumu) from the municipality: whether building is allowed, the building ratio and number of floors. Agricultural land has use and subdivision restrictions, and foreigners are also subject to area and zone limits. Undivided shared title is a frequent source of disputes.
Step 5: Payment and transfer
Pay through a bank and make the final payment on the day of transfer at the land registry. A buyer who does not speak Turkish needs a sworn interpreter at the registry. If you are abroad, the purchase can be completed under a notarised power of attorney.
