Buying an Apartment in Manavgat and Side: What a Lawyer Checks

Buying an apartment in Manavgat or Side differs from Alanya: there are more holiday complexes, a higher share of resale homes and more holiday letting. Before paying a deposit, check the title deed, the building status, service-charge (aidat) debts and the complex rules, and make sure the contract protects your deposit and deadlines.

The Manavgat and Side market

The Manavgat district covers Side, Kumköy, Çolaklı, Evrenseki, Kızılağaç and Manavgat town. Much of the housing consists of holiday complexes with pools, security and a management company. Many buyers plan to let to tourists, so the legal check must cover how the property may be used, not just ownership.

1. Title deed and building status

  • is the owner the seller, and are there co-owners;
  • any mortgage, attachment or sale ban;
  • condominium title (kat mülkiyeti) and occupancy permit (iskan);
  • does the actual unit match the approved plans — illegal alterations can lead to fines.

2. Complex management and service charges

  • current aidat amount and what it covers;
  • any arrears owed by the seller;
  • complex rules on letting and pets;
  • planned major works or extra levies.

3. Holiday letting

Short-term (tourist) letting requires a separate permit, and complex rules or owners' decisions may restrict it. If rental income is the goal, check whether a permit is obtainable before buying. Rental income is taxable in Türkiye.

4. Resale homes

  • utility and property-tax arrears;
  • existing tenants keep their contractual rights;
  • the authority of a seller acting under a foreign power of attorney;
  • the real price declared on the title deed.

5. Contract, deposit and transfer

A deposit paid without a written contract is the most common cause of losses. The contract should set out the property details, price and payment terms, transfer date, deposit refund conditions and each party's liability. At the Manavgat Land Registry, a buyer who does not speak Turkish needs a sworn interpreter, and a valuation report is required for foreign buyers. If you are abroad, the purchase can be completed under a notarised power of attorney.
